Who could be exempt from the anchor price obligation

Minister Šušnjar announced exemptions for intellectual services, activities with prices set by law and public services. What is known and what is not.

There is no final list of exempt activities yet. The Minister of Economy announced that an ordinance will set it, citing as examples intellectual services, activities whose prices are defined by law, such as legal services, and public services. The anchor price (sidrena cijena) obligation otherwise applies to all retail goods and consumer services.

What the minister said

According to the Government announcement, Šušnjar explained the postponement by the need to use ordinances to exclude activities unsuited to the measure. He added that nothing is set in stone and that exemptions will be adjusted in response to feedback, wherever the measure is not realistic and workable.

The announcement came the day before a protest by the Glas poduzetnika association and the SMOi association, which was prompted precisely by anchor pricing.

Who is already outside the obligation

Even without the ordinance, some situations are not covered according to interpretations so far:

Business-to-business only. The decisions target sales to consumers. The Croatian Chamber of Trades and Crafts states in its guidance that the obligation does not cover businesses that deal only with other companies. There is no official Ministry interpretation yet.
Publishing a price list without a website. The obligation to publish a price list applies only to those with their own website. A Facebook or Instagram profile does not count. Displaying the anchor price on premises and in ads still applies.
Special forms of pricing. Under the draft, the base price does not apply to discounts for particular groups of consumers, personalised and dynamically set service prices, or intermediary platforms.

What is still unclear

Exactly which activities count as intellectual services.
Whether the exemption covers only displaying the anchor price or publishing the price list as well.
What happens to activities where some prices are regulated and others are set freely.

What to do while you wait

If you are not sure whether you are exempt, prepare as if you are not. Fines for a legal entity go up to €30,000, and setting up a price list costs far less. You can also submit your question through e-Savjetovanja until 13 November.
